Terms of Service

Telemedicine Services Provider

The telemedicine and clinical services available through the OPTML platform are provided by Telegra MD, a U.S. physician-led telehealth services provider. OPTML operates as a consumer-facing brand and platform; Telegra MD employs or contracts with the licensed U.S. physicians who conduct patient intake review, write prescriptions, manage dosing, respond to messaging, and oversee ongoing patient care. By using the OPTML platform to access telemedicine services, you acknowledge that your clinical relationship is established with a licensed physician within the Telegra MD network, and that all clinical decisions are made by that physician based on your individual medical evaluation.

For information about how patient health data is handled across the OPTML and Telegra MD systems, please see our Privacy Policy and our HIPAA Notice of Privacy Practices.

1. Acceptance

By accessing or using the OPTML website or services, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the service.

2. Nature of the Service

OPTML is a technology platform that connects patients with U.S. licensed physicians and other qualified healthcare providers for the purpose of obtaining telehealth consultations, prescriptions, laboratory testing, and related services. OPTML itself is not a medical practice and does not provide medical care directly.

Services are provided by independent licensed clinicians operating in accordance with the laws of the state in which the patient resides. Prescription medications are dispensed by independently licensed pharmacies, including state-licensed 503A compounding pharmacies.

3. Eligibility

4. Not an Emergency Service

OPTML is not designed for medical emergencies. If you are experiencing a medical emergency, dial 911 or go to your nearest emergency department immediately.

5. Informed Consent

By using the service, you consent to receive care through telehealth. You acknowledge that telehealth involves the electronic transmission of health information and may have limitations compared to in-person care.

6. Compounded Medications

Certain medications offered through OPTML, including compounded semaglutide, tirzepatide, and enclomiphene, are not FDA-approved drug products. They are prepared by state-licensed 503A compounding pharmacies operating under Section 503A of the Federal Food, Drug, and Cosmetic Act. You acknowledge this and consent to the use of compounded medications when prescribed by your clinician.

7. Subscriptions, Billing, and Refunds

7.1 Recurring Billing

Most OPTML plans are subscription-based and renew automatically at the interval you selected (monthly, quarterly, or annually) until canceled. You authorize OPTML to charge your payment method on file at each billing cycle.

7.2 Cancellation

You may cancel your subscription at any time through your account dashboard or by contacting support. Cancellation stops future billings; it does not refund charges already processed.

7.3 Taxes

You are responsible for any applicable sales or use taxes.

8. No Guarantee of Results

Treatment outcomes vary. Individual results depend on biology, adherence, lifestyle, and many other factors. Statements on the OPTML website regarding clinical trial outcomes describe averages observed in peer-reviewed research and do not guarantee that any individual will achieve the same result.

9. Intellectual Property

All content on the OPTML site, including text, graphics, logos, images, and software, is the property of OPTML or its licensors and is protected by U.S. and international intellectual property laws. You may not reproduce, distribute, or create derivative works without written permission.

10. User Conduct

11. Third-Party Services

OPTML may link to or integrate with third-party services (analytics, payment processing, shipping carriers). Your interactions with those services are governed by their own terms and privacy policies.

12. Disclaimers and Limitation of Liability

The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, OPTML disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, OPTML's total liability arising out of or relating to these Terms or the service shall not exceed the amount you paid to OPTML in the 12 months preceding the claim.

13. Dispute Resolution and Arbitration

Any dispute arising under these Terms shall be resolved through binding arbitration administered by a recognized arbitration provider, on an individual basis, except for small-claims matters. You waive your right to participate in a class action to the extent permitted by law. [Final arbitration clause to be drafted by counsel prior to launch.]

14. Governing Law

These Terms are governed by the laws of the State of [Placeholder, to be finalized], without regard to conflict-of-laws rules.

15. Changes to Terms

OPTML may update these Terms. Material changes will be notified by email or by a prominent notice on the site. Continued use of the service after notice constitutes acceptance.
